Monterey Flyers, Inc.
Club Rules
Monterey Flyers, Inc. is a nonprofit corporation which
operates with the goal of providing safe flying at reasonable cost for its
members. According to our By-Laws, the business and affairs of the
corporation shall be controlled by a Board of Directors consisting of a
President, Vice President, Secretary, Treasurer, Chief Pilot, Maintenance
Officer, and Member at Large. Among other duties, the Board must issue,
review, and revise rules and regulations pertaining to all aspects of Club
operations.
The following sections list the rules and regulations as
currently set forth by the Board.
I.I.
Administration
A.A.
Rule making
1.1.
The board is empowered to enact, amend, or rescind any rule or policy of the
club.
2.2.
A written copy of the club rules will be posted in the club hangar and issued
to all new members.
3.3.
An amendment, revocation, or enactment of a club rule or policy shall become
effective following:
Inclusion
in minutes of a board meeting,
Posting in the club hangar, and
Notification of active club members by mail.
B.B.
Membership
1.1.
The categories of membership will be:
1. Flying
a. Active
i. Active
ii. Family Membership
b.
Provisional
c. Pilots covered by separate contractual
agreements
2. Associate
a. Flight instructors who are not flying members
b. Aircraft mechanics and inspectors
c. Other members
Membership categories 1a and 2c may be either single or
family memberships.
2.2.
Only category 1a and 1c members in good standing may exercise full privileges
of club membership. Category 1b members in good standing may exercise
limited privileges as outlined in these rules. Category 2 members may
exercise all club privileges excluding operation of club owned or leased
aircraft, except that category 2a members may operate such aircraft when
providing flight instructional services to category 1 members; category 2b
members may operate the aircraft for maintenance purposes only.
3.3.
The Board will make every effort to act on all applications for new or altered
membership at the first board meeting following the receipt of the application.
4.4.
An application for new membership must be accompanied by all applicable fees
and dues for the current month and, if for category 1a membership, by copies of
the applicant’s current pilot certificate, medical certificate, and evidence of
a current flight review (unless already on file with the club).. If the
board does not approve the application, the initiation fee will be refunded;
and all documents returned.
5.
Category 1b membership allows limited privileges for a period of no more than
30 days.
6.
A club flight instructor may grant a 1b membership upon receipt of an
application form, initiation fee, and dues for the current month.
7.
A provisional member may receive up to three hours of dual instruction.
No solo flight is allowed.
8.
A provisional membership expires after 30 days, regardless of the number of
hours flown.
9.
A member wishing to change status from category 1a to 2c must notify the
treasurer in writing. The change will be effective at the beginning of the next
billing period, following receipt of the request and payment of all previously
billed items.
10.
A member wishing to change status from category 2 to 1 must submit a request
for change of status accompanied by required fees, dues, and documents to the
Board. The change will be effective following approval by the board.
C.C.
Billing
1.1.
All dues and fees will be posted on a fee schedule.
2.2.
The billing period will begin on or about the 26th day of the month
and end on or about the 25th day of the following month. Bills
will be mailed to members on or about the first day of the month.
3.3.
All bills to the club are due in full by the 25th of the
month. All payments not received by the 25th of the following
month are delinquent and subject to a 10% late fee and loss of flying
privileges until payment in full is received.
4.4.
Any member who fails to pay dues for three consecutive months will be so
advised in writing. If no satisfactory reply is received, the member will
be dropped from the club and the account closed.
II.II. Use of Club
Aircraft and Equipment
A.A.
Flight rules
1.1.
The Federal Aviation Regulations will be the primary rules governing the use of
club aircraft.
2.2.
Flight Instructors associated with the Club must remain TSA compliant at all
times.
3.3.
Club members will comply with all federal, state, and local regulations
pertaining to aircraft operations.
4.4.
Club members will comply with all conditions imposed by the applicable aircraft
insurance policy.
5.5.
No club member shall use any club aircraft for commercial purposes. No
club member shall rent or lend any club aircraft to any other person of group
of persons for any purpose.
6.
A category 1a, 1c, 2a, or 2b club member must act as pilot in command of the
aircraft for all aircraft operations.
Eligibility to act as pilot in command of club
aircraft
7.
Each member must have on file with the club a copy of each certificate and
license required for any proposed flight.
8.
Each member must maintain a pilot’s log book. Log book entries must
include verification of recent flight experience and any endorsements required
for proposed flights.
9.
Each member must be checked out in a club aircraft by a club instructor prior
to acting as pilot in command of that make and
model aircraft.
Restrictions
10.
A member who has not acted as pilot in command during the previous 90 day
period shall have a flight check with a club instructor prior to operating club
aircraft.
11.
If the Chief Pilot has reasonable cause to believe that any member is operating
an aircraft in an unsafe manner or in violation of club rules, or applicable
FAR’s, he/she may recommend appropriate action to the Board. Such action
may include the imposition of restrictions on future flights, requiring a
flight check with a club instructor, or other measures. At the Chief
Pilot’s discretion, any such restrictions will take effect immediately.
12.
Student pilots may not operate aircraft solo at night without authorization
from their club instructor.
13.
Only designated club instructors may give instruction in club aircraft.
Flight operations
14.
Pilots will operate each club aircraft in
accordance with that aircraft’s approved operating manual.
15.
A flight plan showing at least the pilot’s name, time and date of departure,
planned duration and route of flight, planned landings, and number of people on
board must be left at the club prior to each flight.
16.
Except in case of emergency, club aircraft will be landed only at established
hard surface airports shown on current sectional charts and/or listed in part 2
of the A. I. M.
17.
Club aircraft may not be operated outside the United
States
without the prior approval of the board.
18.
Aerobatic maneuvers are prohibited. Spins are permitted only under the
direct supervision of a club instructor or FAA inspector/designee.
19.
Members are encouraged to keep the aircraft schedule book as up to date as
possible. Timely scheduling (or canceling) of planned flights is a
courtesy to all members and allows the most productive use of the aircraft.
20.
Aircraft reservations will be honored for 30 minutes after the scheduled
departure time. If the club is not notified of cancellation or
rescheduling within 30 minutes, the reservation will be canceled and the member
may be charged for 30 minutes of flight time, subject to decision of Board.
21.
Each member shall be held responsible for the aircraft scheduled from the
beginning of the pre-flight inspection of the aircraft until the aircraft has
been properly secured after the flight.
22.
The club must be notified as soon as practical if, for any reason, an
aircraft will not be returned on time.
23.
Cross country flights of longer than four days duration or a round trip
distance of 1000 miles or greater must have the prior approval of a club
officer.
24.
When an aircraft will not be returned within 24 hours ,
a minimum of two flight hours will be charged for each 24 hour period.
Upon application to the board, a member may, based in the determination of the
board, be exempted from all or part of the additional charge due to this
provision, if the return was delayed for reasons of weather of equipment
failure.
25.
All aircraft will normally be refueled following each flight, if more than half
their usable fuel has been expended. Failure to refuel the aircraft may
result in the assessment of 0.3 hours of flight time, to be credited to the
next pilot’s account.
26.
No club owned or leased aircraft will be flown on a maintenance or test flight
without the specific approval of either the club maintenance officer or the
club president.
27. Pilots
grounded for any reason may not schedule aircraft.
B.B.
Other Equipment
1.1.
No club equipment shall be removed from the immediate vicinity of the hangar,
except for test or repair.
III.III.
Accidents, Incidents, and Violations
1.1.
Any club member who is involved, as a pilot, in an aviation accident, incident,
violation of FAR’s, or club rules, whether in a club aircraft or not, will be
prohibited from operating club aircraft pending a decision by the Board of
Directors.
2.2.
A board of inquiry, consisting of at least three members, chaired by the Vice
president, shall make an investigation of accidents, incidents, and/or
violations, and shall report its findings to the board of directors for action
and disposition in accordance with the bylaws and rules of the club.
3.3.
Any personal injury to a club member or guest while on the club ramp, in the
club hangar, or a club aircraft shall be reported to the Vice president as soon
as possible.
4.4.
All club members are responsible to the club for the safety of their guests and
the security of club property in the club hangar and on the flight line.
IV.IV. Maintenance
of Club Aircraft
A.A.
100 hour inspections for each aircraft shall be signed off by a certified FAA
mechanic and will be recorded in each aircraft/engine logbook, as appropriate.
B.B.
No individual may remove any unit from any aircraft for maintenance unless
approved by the maintenance officer or club president.
C.C.
An aircraft may be grounded by any board member.
D.D.
Any aircraft which has been grounded with the appropriate notation in the
aircraft notebook and on the aircraft status board will not be returned to
service until approved by the Maintenance officer or the President.
V.V.
Disciplinary Action
A.A.
The board will review any alleged violation of club rules which is reported to
it. The board will then take appropriate
action.
B.
Any
violation of the club rules may result in a registered letter sent by
the Board of
Directors advising dismissal from club.
C.
Any action taken against a member for violation of any rule or
policy may be appealed to the board for re-evaluation. The decision of
the board will be final.
